Acceptance of Terms

Welcome to BetterPal! By downloading, installing, or using the BetterPal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and BetterPal ("we," "us," or "our") regarding your use of the App.

Description of Service

BetterPal is a personal relationship management application for iOS that helps you:

• Organize and manage contact information
• Track relationships and connections between people
• Remember important details, notes, and birthdays
• Visualize your social network
• Manage tags and categories for your contacts

All data is stored locally on your device. The App does not require or provide cloud synchronization.

Subscription Terms and Pricing

Free Tier

• Provides access to store up to 25 contacts
• Includes all core features of the App
• No payment required
• Can be used indefinitely at no cost

Premium Tier

• Provides unlimited contact storage
• Full access to all App features
• Supports us as independent developers
• Available as a monthly or annual subscription

Pricing

• Monthly Subscription: $2.99 USD per month
• Annual Subscription: $19.99 USD per year
• Prices are subject to change with advance notice
• Prices may vary by region based on Apple's pricing tiers

Payment and Renewal

• Payment will be charged to your iTunes Account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal charge will be at the then-current subscription price
• Subscriptions may be managed by you, and auto-renewal may be turned off by going to your Account Settings after purchase
• To cancel, go to: iOS Settings → [Your Name] → Subscriptions → BetterPal → Cancel Subscription

Free Trial

• If we offer a free trial period, it will be clearly indicated at the time of subscription
• Any unused portion of a free trial period will be forfeited when you purchase a subscription to that publication
• Free trial eligibility is determined by Apple and may be limited to one per Apple ID

Refunds and Cancellation

• No refunds are provided for partial subscription periods
• You may cancel your subscription at any time, but you will not receive a refund for the current billing period
• After cancellation, you will retain Premium access until the end of your current billing period
• All subscription purchases and refund requests are subject to Apple's App Store policies
• To request a refund, contact Apple Support or visit https://reportaproblem.apple.com

User Eligibility

You must be at least 13 years old to use BetterPal. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• If you are between 13 and 18, you have obtained parental or guardian consent to use the App

Acceptable Use

You agree to use BetterPal only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon or violate our intellectual property rights or the rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to the App or its systems
• Use the App to harass, abuse, or harm another person
• Transmit any viruses, malware, or other malicious code
• Violate any applicable data protection or privacy laws
• Use the App in any way that could damage, disable, or impair the App

User Content and Ownership

Your Content

You retain all ownership rights to the data and content you create, upload, or store in BetterPal, including:

• Contact information
• Notes and descriptions
• Tags and categories
• Photos and images
• Relationship data

Our Non-Access

Since all data is stored locally on your device, we do not access, store, or claim any ownership of your content. We cannot view, modify, or retrieve your data.

Your Responsibility

You are solely responsible for:

• The accuracy of information you enter into the App
• Ensuring you have the right to store and use information about other people
• Complying with applicable privacy laws when storing personal information about others
• Backing up your data using the export feature
• The security of your device and the data stored on it

Data and Privacy

Your use of BetterPal is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our privacy practices.

Local Storage

All data is stored locally on your device. We do not:

• Store your data on our servers
• Have access to your contact information or notes
• Sync your data to the cloud automatically
• Share your data with third parties (we don't have it to share)

Your Backup Responsibility

You are responsible for backing up your data. We strongly recommend:

• Regularly exporting your data using the export feature in Settings
• Storing backups in a secure location
• Understanding that data cannot be recovered if the App is deleted or your device is lost

Intellectual Property

Our Rights

The BetterPal App, including its design, features, graphics, user interface, code, and all related materials, is owned by BetterPal and protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer or attempt to extract the source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for commercial purposes without our permission
• Rent, lease, sell, or sublicense the App

Service Availability and Modifications

As-Is Service

BetterPal is provided on an "as is" and "as available" basis. We do not guarantee that:

• The App will always be available or uninterrupted
• The App will be error-free or bug-free
• The App will meet all your requirements
• Any defects will be corrected

Updates and Changes

We reserve the right to:

• Modify, update, or discontinue features of the App at any time
• Release new versions with changes to functionality
• Require you to update to the latest version
• Discontinue the App entirely with reasonable notice

iOS Compatibility

BetterPal is designed for iOS devices. We may discontinue support for older iOS versions as Apple releases new operating systems.

Disclaimers and Limitations of Liability

No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERPAL IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERPAL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, even if we have been advised of the possibility of such damages
• Errors or inaccuracies in content you enter into the App
• Issues arising from iOS updates, device malfunctions, or device loss
• Unauthorized access to your device or data
• Any damages arising from your use or inability to use the App

Data Loss

Since data is stored locally on your device, we are not responsible for:

• Data loss due to device failure, loss, or theft
• Data loss due to app deletion or iOS updates
• Data corruption or errors
• Your failure to back up data using the export feature

Maximum Liability

In no event shall our total liability to you for all damages exceed the amount you paid us in the past twelve (12) months, or $100, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless BetterPal and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

Termination

Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Canceling your subscription (if applicable)

Termination by Us

We reserve the right to:

• Suspend or terminate your access to the App if you violate these Terms
• Discontinue the App entirely with reasonable notice
• Refuse service to anyone at any time for any reason

Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• If you delete the App, all locally stored data will be permanently deleted
• Subscription fees already paid are non-refundable unless required by law
• Provisions of these Terms that by their nature should survive termination shall survive

Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the App if changes are material
• Post the updated Terms on our website at betterpal.app/terms

Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

• First, good faith negotiations between you and us
• If negotiations fail, binding arbitration in accordance with the rules of the American Arbitration Association
• Arbitration shall take place in California, USA

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterPal regarding the App.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

Apple-Specific Terms

Since BetterPal is distributed through the Apple App Store:

• These Terms are between you and BetterPal, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for the App or its content
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any)
• Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims relating to the App or your use of it
• Apple is a third-party beneficiary of these Terms and may enforce them
